Ne dopuštamo Vam korištenje bilo kakvih usluga agencije Istra Vacation ukoliko niste potvrdili da ste pročitali navedene uvjete.
Agencija Istra Vacation upravlja web stranicom www.istra-vacation.com i ista je namijenjena korištenju svim korisnicima koji joj pristupaju iz bilo koje zemlje. Web stranica je strukturirana i vođena u skladu sa zakonima Republike Hrvatske.
Turistička agencija “Istra Vacation” posluje kao agencija za sve nekretnine koje su navedene na našoj web stranici: www.istra-vacation.com.

Vrsta ugovora
Opći uvjeti za pružanje usluga smještaja sastavni su dio ugovora između “Istra Vacation” by DAH Istra d.o.o., kao putničke agencije ili ovlaštenog agenta, i Unajmljivača koji prihvaća ponuđen smještaj. Sve navedeno u općim uvjetima predstavlja pravnu obvezu za goste, kao i za agenciju Istra Vacation (DAH Istra d.o.o.) Opći putnički uvjeti također su objavljeni na internet stranicama putničke agencije Istra Vacation.
Agencija Istra Vacation (DAH Istra d.o.o.) se obvezuje poduzeti sve preduvjete za pružanje točnih informacija svojim korisnicima. Sve informacije, podatke i slike o kapacitetima smještaja, agencija Istra Vacation (DAH Istra d.o.o.) je prikupila od vlasnika smještaja. Iako su zaposlenici agencije Istra Vacation (DAH Istra d.o.o.) provjerili sve informacije, Agencija ne preuzima odgovornost za pogreške, nemarnosti, i kašnjenja u ažuriranju informacija.
U svojstvu pružanja usluga smještaja gostima u privatnim apartmanima, sobama ili vikendicama (krajnji davatelj usluge je Unajmljivač – fizička ili pravna osoba koja je zaključila ugovor o posredovanju s putničkom agencijom “Istra Vacation”), tvrtka DAH Istra d.o.o. posluje kao posrednik sukladno odredbi članka 10. Pravilnika o porezu na dodanu vrijednost (NN br.79/13 i 85/13), i za svoje poslovanje odgovara sukladno pozitivnim propisima RH.
Ispravni navodi, prihvaćanje
Maksimalni broj unajmljivača
Za svaki je smještaj definiran maksimalni broj dopuštenih osoba. Unajmljivač je prije dolaska obvezan navesti broj osoba, starost članova grupe kao i njihovu kombinaciju. Boravak se može uskratiti bez naknade troškova u slučaju da se prekorači limit broja dopuštenih osoba, a bez izričite pisane suglasnosti agencije Istra Vacation ili vlasnika smještaja.

Starosna granica
Osobe mlađe od 18 godina ne mogu iznajmljivati smještaje. Unajmljivač mora potvrditi da ima barem 18 godina, Ukoliko se ispostavi da grupa Unajmljivača nema tražen prosjek godina za smještaj (bez djece mlađe od 12 godina), boravak se može uskratit bez naknade troškova.

Kućni ljubimci
U nekim smještajnim jedincima, kućni su ljubimci zabranjeni, dopušteni uz naknadu ili besplatno. Ukoliko dolazite s kućnim ljubimcima bez izričite suglasnosti u pisanom obliku, boravak se može uskratiti bez nakande troškova. Ni agencija Istra Vacation niti vlasnik smještajne jedinice nisu odgovorni za moguće bolesti, ozljede ili smrt kućnih ljubimaca tijekom boravka.

Kućni red
Svaka smještajna jedinica ima svoj kućni red koji je istaknut na vidljivom mjestu i na raspolaganju Unajmljivaču i njegovoj grupi. Unajmljivač i njegova grupa dužni su pridržavati se pravila kućnoga reda. Ukoliko se Unajmljivač i njegova grupa ne pridržavaju pravila kućnoga reda, to se smatra ozbiljnim kršenjem odredbi ugovora o najmu. U tom slučaju vlasnik smještajne jedinice i/ili agencija Istra Vacation imaju pravo otkazati ugovor o najmu smještaja. Otkazivanje stupa na snagu odmah, bez otkaznog roka, a Unajmljivač je zajedno sa svim osobama koje borave tamo dužan napustiti smještajnu jedinicu u roku od 2 (dva) sata. Unajmljivač nema pravo tražiti povrat plaćenog iznosa za smještaj od vlasnika smještajne jedinice ili agencije Istra Vacation.

Novosagrađene vile
U slučaju rezervacije novoizgrađenih vila, Unajmljivač mora biti svjestan da možda nije bilo dovoljno vremena za uzgoj travnjaka, zelenila, biljaka i cvjetnica te ostale hortikulture u vrtu.

Bazen i vrtložna kupka (whirlpool)
Unajmljivač i njegova grupa dužni su pridržavati se svih uputa za korištenje bazena radi vlastite sigurnosti, te onih uputa koje propisuju vlasnik smještaja ili agencija Istra Vacation. Unajmljivač je dužan koristiti bazen na razuman način. Djeca ne smiju biti blizu područja bazena bez nadzora odraslih osoba. Unajmljivač koristi bazen na vlastitu odgovornost. Ukoliko se smještaj rezervira izvan ljetne sezone, postoji mogućnost da bazen nije u uporabi. Trebate imati na umu da je korištenje vrtložne kupke povezano s određenim zdravstvenim rizicima, te istu koristite na vlastitu odgovornost. Voda u vrtložnoj kupci možda neće biti topla do kasno navečer na dan dolaska Unajmljivača. Zabranjeno je stajati na pokrovima vrtložne kupke. Pokrovi se koriste za izolaciju i nisu dizajnirani i prilagođeni da izdrže težine osobe, te mogu lako puknuti. U slučaju puknuća pokrova, Unajmljivač je obvezan nadoknaditi štetu izravno vlasniku smještaja.

Uvjeti plaćanja
Rezervacija
Za sve rezervacije koje su napravljene 32 ili više dana prije početka razdoblja najma, primjenjuju se sljedeći uvjeti:
Avansna uplata u iznosu od 30% od ukupno dogovorene cijene smještaja plaća se odmah ukoliko plaćate putem PayPala. Ukoliko plaćate nalogom banke na naš račun, 30% avansa mora biti doznačeno na račun agencije Istra Vacation u roku od 3 (tri) dana.
Čim agencija Istra Vacation zaprimi Vašu potvrdu rezervacije putem elektroničke pošte te čim je provedena djelomična uplata od 30% od ukupnog iznosa, rezervacija je sigurna. Sve dok se ne provede prva uplata od 30%, rezervacija smještaja nije sigurna i smještaj je raspoloživ za rezerviranje za druge zainteresirane strane.
Ostatak iznosa ili 70% od ukupnog isnosa, unajmljivač se obvezuje platiti po dolasku direktno iznajmljivaču po dolasku.
Nepravovremeno plaćanje smatrat će se otkazivanjem s Vaše strane te se obračunavaju troškovi za otkazivanje koji su definirani pod Otkazivanje.
Ukoliko je manje od 32 dana između dana rezervacije i dana početka najma, obavezni ste cjelokupni iznos platiti odmah.
Važna napomena: Kod rezervacije Vam se šalje broj rezervacije; navedite taj broj prilikom plaćanja. Ukoliko ne navedete broj rezervacije, agencija Istra Vacation neće moći povezati plaćanje s Vašom rezervacijom.

Izmjene
Obavezni ste pratiti elektroničku poruku s potvrdom koju ste zaprimili od nas odmah nakon primitka uplate. Ukoliko niste u mogućnost putovati, imate pravo svoj smještaj prenijeti na drugu osobu. U tome slučaju druga osoba postaje Unajmljivač. Dužni ste o tome obavijestiti agenciju Istra Vacation u pisanom obliku najmanje 14 dana prije dolaska. Ukoliko želite izmijeniti svoju rezervaciju nakon što je potvrđena, morate to učiniti u pisanom obliku što prije, jer možda naknadne izmjene neće biti moguće. Potrudit ćemo se izaći Vam ususret u takvim slučajevima, ali ne možemo jamčiti isto.

Otkazivanje
Otkazivanje od strane Unajmljivača
Troškovi otkazivanja obračunavaju se od dana kada “Istra Vacation” by DAH Istra d.o.o. zaprimi pisani zahtjev za otkazivanjem, i to na sljedeći način:

Za otkazivanje do 120 dana prije dolaska uz opravdan razlog, “Istra Vacation” by DAH Istra d.o.o. obračunava 5% od ukupnog iznosa rezervacije, koji se naplačuje od akontacije.

Za otkazivanje unutar 120 dana prije dolaska, naplaćuje se cijelokupni iznos akontacije (30% od ukupnog iznosa rezervacije).

Obavezni ste poslati poruku o otkazivanju elektroničkim putem izravno na info@istra-vacation.com. Dan primitka pisane elektroničke potvrde smatra da se danom otkazivanja.

Otkazivanje od strane agencije Istra Vacation
Ukoliko nastupe okolnosti u kojima se otkazuje već rezervirani smještaj, Unajmljivač će o tome biti što prije obavješten, a ukoliko je moguće, agencija Istra Vacation će ponuditi alternativu. Ukoliko ponuđena alternativa nije prihvatljiva, te ukoliko agencija Istra Vacation ne može ponuditi ikakvu drugu alternativu, uplaćeni se iznos vraća Unajmljivaču. Unajmljivač nema pravo na druge nadoknade osim već uplaćenog iznosa.

Polog
Unajmljivač je dužan ostaviti gotovinski polog pri dolasku u smještajnu jedinicu, kao instrument osiguranja za eventualno počinjene štete. Iznos pologa koji je pri dolasku dužan dati vlasniku smještaja naveden je pisanoj potvrdi rezervacije. Polog služi kao instrument osiguranja vlasniku smještaja za štete počinjene u smještajnoj jedinici, a vlasnik smještajne jedinice ima pravo pokriti štetu iz pologa. U slučaju da je uzrokovana šteta veća od iznosa depozita, Unajmljivač je dužan platiti cjelokupni iznos štete vlasniku smještaja. Ukoliko nije počinjena ikakva šteta u smještajnoj jedinici, vlasnik smještaja je dužan vratiti Unajmljivaču iznos pologa kod primopredaje ključeva po odlasku Unajmljivača. Molimo Vas da osigurate novčani iznos pologa pri dolasku u smještajnu jedinicu. U protivnom se ulazak u smještajnu jedinici može odgoditi sve dok ne osigurate polog.

Dolazak i odlazak
Po dolasku, Unajmljivač je dužan predati svoje putne i osobne dokumente vlasniku smještaja, koji će potom prijaviti boravak Unajmljivača te odmah nakon toga vratiti osobne dokumente, pod uvjetom da je plaćanje provedeno.
Dolazak je obavezan između 16 i 20 sati po srednjoeuropskom vremenu, a odlazak do 10 sati po srednjoeuropskom vremenu.
U slučaju da dolazak nije moguć do 20 sati, Unajmljivač je dužan obavijestiti vlasnika smještaja, s kojim će dogovoriti preuzimanje ključeva. U slučaju da Unajmljivač želi produljiti svoj boravak, dužan je odmah obavijestiti vlasnika smještaja. Ukoliko je željeno razdoblje raspoloživo, vlasnik će Unajmljivaču produljiti rezervaciju boravka. U slučaju ranijeg odlaska, Unajmljivač je dužan platiti iznos naveden u obvezujućoj rezervaciji.

Čišćenje
Čišćenje smještajne jedinice od strane agencije Istra Vacation
Vaša će biti smještajna jedinica biti čista u trenutku Vašeg dolaska. Ugovor sklopljen između agencije Istra Vacation i vlasnika smještaja obvezuje vlasnika da dočeka Unajmljivače u čistoj i prikladno pripremljenoj smještajnoj jedinici. Sve primjedbe ili napomene vezane uz čistoću ili inventar podnose se predstavniku na dan dolaska (u roku ud 24 sata). Unajmljivač je dužan smještajnu jedinicu ostaviti u istom stanju u kakvom ju je i preuzeo.

Čišćenje smještajne jedinice od strane Unajmljivača
Pri napuštanju smještajne jedinice, Unajmljivač je dužan obratiti pažnju na sljedeće stvari: (čisto) posuđe i pribor za jelo moraju biti pospremljeni, a preostalo posuđe za kuhanje spremljeno u predviđene ormariće. Perilica posuđa (ukoliko postoji) mora biti prazna.
Ostavite plahte na krevetu. Dužni ste iznijeti smeće iz smještajne jedinice te ga zbrinuti za to predviđene kontejnere (ne u sklopu kuće)!
Kamin i roštilj moraju biti prazni i čisti.
Dužni ste namještaj na terasi vratiti na pravo mjesto, te ste dužni pobrinuti se da ne ostane smeća u vrtu ili na terasi.
Dužni ste smještajnu jedinicu ostaviti u čistom stanju..
Ukoliko smještajnu jedinicu ne napustite u gore opisanom stanju, vlasnik smještaja ima pravo obračunati od Vašeg pologa iznos za dodatno čišćenje do maksimalnih 250 eura. Ukoliko je krevetnina potrgana i ima mrlje (poput boje ili tinte) ili je oštećena na bilo koji drugi način i više nije upotrebljiva, vlasnik smještaja će odbiti iznosa iz Vašega pologa.

Pravo pristupa
Osoblje, zaposlenici i predstavnici agencije Istra Vacation ili vlasnika smještaja imaju pravo pristupa smještajnoj jedinici u svako vrijeme. Vlasnik smještaja ili agencija Istra Vacation nastojat će Unajmljivača obavijestiti o svojim posjetima.

Komunalije
U slučaju da je tijekom Vašeg boravka obustavljena opskrba nekih komunalija (npr. voda, električna energija, plin), agencija Istra Vacation nema utjecaje na takve događaje te nije odgovorna za takve obustave. Ukoliko se u smještajnoj jedinici nalaze plinske boce, moguće je da se nakon nekog vremena isprazne. Ukoliko nema rezervnih plinskih boca u smještajnoj jedinici, predstavnik će boce zamijeniti u roku od dva dana nakon obavijesti vlasniku smještaja.

Obveze i odgovornosti
Obveze i odgovornosti Unajmljivača
Tijekom boravka u smještajnoj jedinici kao Unajmljivač u potpunosti ste odgovorni za unajmljenu smještajnu jedinicu, inventar i ostalu imovinu u smještajnoj jedinici. Štetu nastalu Vašom krivnjom ili krivnjom Vaše grupe dužni ste nadoknaditi i predstavnik će istu odmah obračunati. Vlasnik smještaja ima pravo u tu svrhu koristiti polog. U slučaju ekstremnih šteta u smještajnoj jedinici ili ozbiljnih neugodnosti za ostale goste uzrokovane od strane Unajmljivača, agencija Istra Vacation ili vlasnik smještaja imaju pravo trenutno otkazati ugovor bez ikakve nakande troškova. Parkiranje kamp kućica ili postavljanje šatora strogo je zabranjeno.
Ukoliko u smještajnoj jedinici želite organizirati privatna događanja (npr. zabave, vjenčanja, koktel partije), prvo ste dužni od agencije Istra Vacation/vlasnika smještaja zatražiti suglasnost.
Vlasnik smještaja ima pravo zahtijevati dodatnu naplatu i/ili povećati polog.

Obveze i odgovornosti agencije Istra Vacation
Agencija Istra Vacation djeluje kao predstavnik vlasnika smještaja i stoga agencija Istra Vacation nije odgovorna za išta više od obveza koje kao posrednik provodi između Unajmljivača i vlasnika/iznajmljivača smještaja. Agencija Istra Vacation može biti samo odgovorna za plaćenu naknadu najma od strane Unajmljivača. Agencija Istra Vacation nije odgovorna za gubitak, krađu, štetu, kršenje ili odgodu uzrokovanu događajima koji nisu u našoj kontroli, a uzrokovao ih je Unajmljivač i njegova grupa ili su Unajmljivač i njegova grupa pretrpjeli iste tijekom boravka u smještaj jedinici. Ni agencija Istra Vacation niti vlasnik smještaja nisu odgovorni za smrt ili ozljede bilo kojeg člana grupe Unajmljivača, ili bilo koje druge osobe u smještajnoj jedinici. Agencija Istra Vacation nije odgovorna za ikakva ometanja tijekom boravka, neispravnost tehničke opreme u smještajnoj jedinici, trenutnu obustavu vode i električne energije, te građevinske radove u susjednom području.
Ni agencija Istra Vacation ni vlasnik smještaja nisu odgovorni za buku ili ometanje izvan granica smještajne jedinice i koji su izvan naše kontrole. U slučaju da je izvor buke postojao i prije Vašeg dolaska i da smo o tomu obavješteni, kontaktirat ćemo Vas i obavijestiti o istome.
U smještajnim jedinicama koje se nalaze u ruralnim područjima može doći do pojava flore i faune, kao npr. komarci, ose, mravi, lokalni psi itd., kao i nekih drugih aktivnosti kao što su uzgoj stoke, odvodnja, itd.
Agencija Istra Vacation nije odgovorna za sljedeće događaje: štrajk, rat, monetarnu krizu, političke ili društvene nemire, bolesti, karantene, događaje više sile ili bilo koje događaje ili neočekivane uvjete koji su izvan njezine kontrole.
Agencija Istra Vacation nije odgovorna za ozljede nastale aktivnostima kao što su karting, jahanje na vodi (jet-ski), jahanje konja, golf, najam i vožnja motora, skutera i ostalih vozila, ronjenje, plivanje, padovi s ruba bazena, posklizavanje na mokrim pločicama ili stepenicama, kao ni za ozljede uzrokovane roto-vratima. Stoga je svaki unajmljivač i njegovi pratitelji suglasan da u takvim i sličnim aktivnostima sudjeluju dobrovoljno, te da sami preuzimaju i prihvaćaju rizike za nastale ozljede, bolesti, štete ili gubitke.
Agencija Istra Vacation odgovorna je za točan opis smještajne jedinice. Međutim, opisi i dojmovi o smještajnoj jedinici i neposrednog područja, uključujući objekte, opremu itd. mogu se zbog svoje prirode ili privremenih sezonskih utjecaja razlikovati od opisa na web stranici agencije Istra Vacation.
Ukoliko smatrate da bez obzira na sve poduzete mjere i napore od strane agencije Istra Vacation imate pravo na reklamaciju vezanu uz Vaš smještaj, potrebno je odmah telefonski obavijestiti vlasnika smještaja/agenciju Istra Vacation na broj: +385 (0)91 913 0290 ili putem elektroničke pošte na info@istra-vacation.com. Ukoliko nas ne obavijestite o problemu tijekom Vašeg boravka, Vašu reklamaciju možemo odbiti.
Molimo Vas da jasno navedete broj svoje ID rezervacije i naziv smještajne jedinice. Pristupamo rješavanju Vaše reklamacije s punom predanošću. U slučaju bilo kakvih problema tijekom Vašeg boravka u našim smještajima, dostupni smo na interventni telefon od 0-24 sata.

Nadležnost suda
Ugovorne se strane obvezuju da će u slučaju sporova iste pokušati riješiti dogovorno. Ukoliko u tomu ne uspiju, ugovara se nadležnost Općinskog suda u Puli te se primjenjuju zakoni Republike Hrvatske.

1. Introduction
DAH Istra d.o.o. based in Pula, Ciscuttijeva ulica 15, OIB: 76162237530 (hereinafter: DAH Istra ), must collect and use certain information about individuals in their business. The purpose of this policy is to ensure that DAH Istra is fully compliant with legal, organizational and technical obligations regarding the protection of personal data. All DAH Istra employees are fully acquainted with the content of this policy and ensure its application when handling or processing personal data. Employees whose tasks include personal data handling are adequately educated in terms of their tasks in relation to the protection of personal data. This policy applies to any personal information held by DAH Istra in relation to any person, who is currently or will be a customer, supplier or contact. This policy is designed to prevent the occurrence of potential damage to DAH Istra and its employees and respondents and to ensure that processing of personal data by DAH Istra is fully in accordance with the law and other regulations.
2. Definition and Application
Personal data refers to all data relating to an individual whose identity has been identified or can be identified, that is, an individual who can be identified directly or indirectly, in particular with the help of identifiers such as name, identification number, location information, network identifier or with the help of one or more factors inherent in the physical, physiological, genetic, mental, economic, cultural or social identity of that individual. DAH Istra collects and processes personal data of respondents in accordance with the Personal Data Protection Act (OG 103/03, 118/06, 41/08, 130/11, 106/12), other Croatian legislation, Directive 95/46 / EC and by General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679 of the European Parliament and of 27 April 2016). The collected data of DAH Istra is kept in an appropriate manner and ensures their confidentiality. DAH Istra collected data will not be passed on to third parties without the permission of the respondent, except when it is necessary for the execution of legal obligation of DAH Istra, in cases where this is necessary for the performance of tasks carried out in the public interest or in cases where the respondent has disclosed this information as well as other relevant regulations in certain cases. Right to information
The respondent has the right, at any time, to seek notification if his/her personal data is being processed and for what purpose, who the processing manager is, contact information of data protection officers, what categories of personal data are processed, for which period are they handled or stored, what the source of access of their personal information is, who are all the recipients of his/her personal data, as well as the rights of notice to other rights listed in this policy (right to access, right to remedy, the right to delete, the right to restrict processing and the like).
The right of access
The respondent is entitled to receive confirmation from DAH Istra if they are processing personal information related to them, then get access to the
data and information about:
– the purpose of processing;
– the categories of personal data processed;
– the recipients or categories of recipients to whom the data are presented or will be presented;
– if possible, the period in which the data is stored, ie on the criteria by which the period can be established;
– the request of correction or deletion of personal data or restricting the processing of personal data that concerns the respondent or the right to object to such processing;
– the right to file a complaint with the supervisory authority;
– if personal data is not collected by the respondent, each available information about their source;
– the existence of automated decision-making, including creating a profile with consequences.
Right
to a correction
The respondent has the right, without unnecessary delay, to ask DAH Istra for corrections of incorrect personal information that relates to him/her. The respondent is entitled to supplement the incomplete personal data, inter alia, by providing an additional statement.
Right to erasure (‘right to be forgotten’)
The Respondent has the right to ask DAH Istra to terminate, without delay, personal information related to him/her; if the personal information is not necessary in relation to the purposes for which they were collected or to other ways it is processed; if the respondent withdraws from the agreement the processing privilege is based on and there is no other legal basis for processing; if the respondent files an objection to the processing; if the personal data is illegally processed, if the personal information has to be deleted in order to respect its legal obligations from the Union law or the law of the Member State to which it applies is subject to DAH Istra, if personal information is collected in connection with providing information services to a child.
This does not apply if the processing is necessary (and to the extent of which it is necessary) in order to exercise the right to freedom of expression and for the purpose of respecting the legal obligation required by processing in the Union law or the law of the Member State to which it is subject DAH Istra; for the performance of a public interest task or in carrying out the official authority of DAH Istra; due to the public interest in public health, for archival purposes in public interest; for the purpose of scientific or historical research, for the establishment, enforcement or defence of legal requirements.
Right to file complaints to the supervisory body
The respondent has the right, within his/her own special circumstances, to lodge an objection to the processing of personal data relating to him/her, including the making of a profile, in cases where the processing is necessary for the performance of a public interest task or in the exercise of the official authority of DAH Istra, necessary for the legitimate interests of DAH Istra or a third party. DAH Istra may no longer process personal data unless DAH Istra proves that there are convincing legitimate reasons for processing that go beyond the interests, rights and freedoms of the respondent or for the establishment, enforcement or defence of legal requirements. If personal data is processed for the purpose of direct marketing, the respondent has at any time the right to file an objection to the processing of personal data relating to him for the purposes of such marketing, including the making of a profile to the extent that is associated with such direct marketing.
Right to data portability
The respondent has the right to receive personal information related to him/her provided by DAH Istra in a structured, commonly used and machine format, and is entitled, without interruption by DAH Istra, to transfer this data to another processing manager if the processing is based on the agreement and if the processing is carried out by an automated means.
The Respondent is entitled to direct transfer from DAH Istra to another Dealer if this is technically feasible and this right may not adversely affect the rights and freedoms of others.
Rights related to automated decision making including profiling
The respondent has the right not to relate to a decision that is based solely on automated processing, including the production of a profile that produces or impacts the relevant legal effects on it, unless such decision is required to conclude or execute the contract between the respondent and DAH Istra, if allowed by the law of the Union or the law of the Member State subject to DAH Istra and or based on the express consent of the respondent.
The right of withdrawal of consent
The respondent’s agreement is one of the legal bases for processing data related to the respondent. The respondent has the right at any time to withdraw the privilege he has given. Withdrawing of consent stated in the agreement does not affect the legitimacy of processing data that was made prior to retiring of the agreement.
The right to limit processing
The Respondent has to ask for a restriction on the processing of his personal data: if he disputes the accuracy of his personal data – for the period required for DAH Istra to check that accuracy, if the processing of his personal data is illegal and does not require deletion but limitation of processing only if DAH Istra no longer needs his personal but the existence of the same is necessary for the fulfilment of his legal requirements, if he has filed an objection to the processing, he has the right to request a processing limit for the period to determine if the legitimate reasons for DAH Istra exceed the reasons for his complaint.

In order to exercise his / her rights, the respondent should contact the data protection officer by sending a written notice or request to the DAH Istra Personal Data Protection Officer by electronic mail using his email address given by DAH Istra d.o.o. or by post to: Ciscuttijeva ulica 15, 52100 Pula or by submitting a personal statement directly to the business premises of DAH Istra d.o.o., by prior announcement on the phone number +385959130290 with identification of the valid personal document.

4. Principles of Personal Data Protection:
DAH Istra d.o.o. considers legitimate and correct handling of personal data an important issue and therefore will ensure that personal data is treated legally and correctly. For that purpose DAH Istra d.o.o. fully supports and adheres to the principles of protection data. 

The principles of data protection require that personal information:
• must be treated fairly and legally, and in particular that they must not be treated if the conditions stipulated by the regulations are not met;
• are collected only for one or more specific and legitimate purpose and must not be allowed to continue to be processed in any way that would be incompatible with these purposes;
• the processing must be adequate, relevant and not excessive in relation to the purpose or the purposes for which they are being processed, and the data must be accurate and up-to-date;

5. DAH Istra d.o.o. activities related to data processing:
DAH Istra d.o.o. undertakes the following:
• fully respects the conditions for fair collection and processing of personal data;
• fulfils the obligation to specify the purpose for which the personal data is processed;
• collects and processes adequate personal data only to the extent necessary to meet operational needs or in accordance with all legal requirements;
• Provide all necessary information to the Personal Data Protection Agency;
• Perform a strict verification of the length of personal data retention;
• Ensures that the right person whose data is processed can fully comply with the protection of personal data;
• Undertake appropriate technical and organizational security measures for the protection of personal data;
• Ensures that personal data are not transmitted abroad without insurance coverage;

DAH Istra may publish its cookie content on its website to promote and track traffic statistics based on the interests and information of visitors to the DAH Istra website from social networks. If the respondent uses the content on social networks DAH Istra or in apps, the cookie with the mentioned networks and apps could be stored on the recipient’s device from which he/she accesses the DAH Istra website. Visitors have the right to exclude cookies. Internet browsers are typically programmed so that accepting cookies is the default setting, but can be easily set by the respondents by changing their browser settings. If a respondent wants to restrict or block all cookies that include websites / applications of DAH Istra (which may disable the use of certain sites) or other sites / applications, the respondent can do so in the browser settings. In the event of a violation of personal data likely to cause a high risk to the rights and freedoms of the respondent, DAH Istra informs the data subject of personal data breach without undue delay, unless DAH Istra has undertaken appropriate technical and organizational protection measures and these measures are applied to the personal data affected violation of personal data, in particular those that make personal data incomprehensible to any person who is not authorized to access them, or if DAH Istra has taken any further action to ensure that it is no longer likely to be at high risk for the rights and freedoms of the respondent, requires disproportionate effort, in which case DAH Istra will apply public notice or similar measure by informing respondents in an equally effective manner.

The general conditions for offering services for accommodations are part of the contract between “Istra Vacation” by DAH Istra d.o.o., as a travel agency or authorized agent, and the the Renter who accepts the offered arrangement. Everything that is listed in the general conditions represents a legal commitment for the guests, as well as for Istra Vacation (DAH Istra d.o.o.) The general travel conditions are also published on the Internet pages of Istra Vacation travel agency.

Istra Vacation (DAH Istra d.o.o.) commits itself to undertake all precautions to offer true information to its users. All the information, data, and pictures that are related to the capacity of accommodations, Istra Vacation (DAH Istra d.o.o.) collected from the accommodation owners. Even though all information is checked and controlled by employees of Istra Vacation (DAH Istra d.o.o.), the Agency does not take responsibility for mistakes, negligence, and delays in updating informations.

In the provision of guest accommodation services in private apartments, rooms and holiday homes (the ultimate service provider is the renter – a private or legal person who has concluded a cooperation contract with “Istra Vacation” travel agency) company DAH Istra d.o.o. performs as a travel organizer where the service is performed on its behalf and applies the special taxation procedure (Article 91 of the VAT Act).

Maximum number of Renters
For every accommodation there is a maximum number of persons allowed. It is the Renter’s duty to state the number, age of the group members as well as their combination before arrival. At violation of the limit of the permitted number of persons without explicit permission in written form by Istra Vacation or by the property owner, the stay can be denied without reimbursement of costs.
Age limit
Accommodations can not be hired by persons under the age of 18. The Renter confirms that he/she is at least 18 years of age. If it turns out that the Renter’s party doesn’t have the required average age for the accommodation (excluding children below 12 years), the stay can be denied without any reimbursement.
Pets
In some accommodation properties, pets are prohibited, allowed for a fee or for free. If you arrive with them without explicit permission in written form, the stay can be denied without any reimbursement. Istra Vacation nor the accommodation property owner do not take over any responsibility for a possible illness, injuries or death that the pets might suffer during the stay.
House order
Each property has its house order which is put in a visible place and available to the Renter and his group. Renter and his group are obliged to obey the house order rules. If the Renter and his group do not obey the house order rules, that can be considered a severe breach of the rental contract provisions. In that case, the property owner and/or Istra Vacation are entitled to terminate the rental contract, which comes into force immediately, without the notice period, and the Renter is obliged to leave the property permanently with all the persons who stay there within 2 (two) hours. The Renter is not entitled to demand the return of the paid accommodation price from the property owner or Istra Vacation.
Newly built villas
At the reservation of the newly built villas the Renter must be aware that it might happen that there was not enough time for the grass, plants, flowers or other horticulture to grow in the garden.
Swimming pool and whirlpool
The Renter and his group are obliged to obey the instructions of any kind which refer to the usage of swimming pools and which are given by the property owner or Istra Vacation due to his/her own safety. The Renter is responsible for using a swimming pool in any sense. The children must not be present at the swimming pool area without the supervision of adults. The Renter uses the swimming pool at his/her own responsibility. If the accommodation is reserved out of the summer season it might happen that the swimming pool is out of use. You should take into consideration that the usage of whirlpools is related to certain health risks, and you use it at your own responsibility. The water in the whirlpools might not be warm until the late evening hours on the day of the Renter`s arrival. It is forbidden to stand on the whirlpool lids. The lids are used for isolation, they are not designed and adjusted to bear the weight of a person and can be easily broken. In case that the lid is broken, the Renter is obliged to compensate damage directly to the property owner.

Reservation
For the reservations which were made 32 days or more before the beginning of the rental period, the following conditions will be applied:
30% advance payment of the total agreed accommodation price is due for payment immediately if you choose to pay with Pay Pal. If you choose to pay with a bank transfer to our account, the 30% advance payment has to be received by Istra Vacation within 3(three) days.
As soon as Istra Vacation receives your reservation confirmation via email and you have made a partial payment of 30% of the full amount, the booking is secured. As long as the first payment of 30% is not made, the reservation of the accommodation will be unsecured and open for booking by other parties.
The payment method of the remaining balance of 70% of the total agreed accommodation price must be confirmed at the time of booking is made by both sides, the Renter and Istra Vacation. If the payment is made by bank transfer or Pay Pal, the remaining amount has to be remitted no later than 32 days before the start of the term of a lease. If we agree on payment of the remaining balance in cash, it is due for payment immediately after the Renter`s arrival, and the Renter is obliged to pay the amount directly to the owner. There is no possibility to pay electronically (Pay Pal/Credit Cards) at the accommodation property.
Failure of timely payment will be seen as a cancellation by your side and will carry cancellation costs as set out in Cancellations.
If between the day of the reservation and the start of the term of a lease are less than 32 days, you have to pay the full amount immediately.
Important: With the booking you receive a reservation number, mention this number with your payment. If you don’t mention the reservation number, Istra Vacation can not relate the payment to your booking.

You are obliged to check the confirmation email that you receive from us immediately on payment receipt. If you are prevented from traveling, you have a right to transfer your accommodation to another person. In that case, another person becomes the Renter. Istra Vacation must be notified about this in writing no later than 14 days before arrival. If you wish to make other changes to your booking after it has been confirmed you must notify us in writing as soon as possible, as it may not be possible to make changes later. We will try to assist you but we can not give any guarantees.

Cancellation by the Renter
The cancellation costs will be calculated from the date on which “Istra Vacation” by DAH Istra d.o.o. receives a written request for the cancellation, and it is as follows:

For the cancellation up to 30 days prior the arrival, “Istra Vacation” by DAH Istra d.o.o. charges 5% of the full price of the reservation, a minimum of 15 EUR.

For the cancellation in the period between 30 and 7 days prior the arrival , “Istra Vacation” by DAH Istra d.o.o. charges 85% of the full price of the reservation.

For the cancellation in the period between 7 and 1 days prior the arrival, “Istra Vacation” by DAH Istra d.o.o. charges 93% of the full price of the reservation.

If the traveler does not arrive to the destination or cancels the service of the accommodation after it began, “Istra Vacation” by DAH Istra d.o.o. charges the full price of the reservation.

For every cancellation of the reservation “Istra Vacation” by DAH Istra d.o.o. charges 15 EUR of administrative expenses.

You must send cancellations directly by email to info@istra-vacation.com. The day of the reception of the written email confirmation is considered as the day of the cancellation.

Cancellation by Istra Vacation
If there appear any circumstances causing a cancellation of the already reserved holiday accommodation, the Renter will be informed about that as soon as possible, and if possible Istra Vacation will offer an alternative. If this alternative is not accepted or if Istra Vacation can not offer any alternative, the already paid amount will be reimbursed. The Renter has no more rights than the reimbursement of the already paid amount.

The Renter is obliged to leave a deposit in cash on the arrival to the accommodation for the insurance of the possible caused damages. The deposit sum that the Renter is obliged to give to the property owner at the arrival shall be stated in a written reservation confirmation. The deposit serves as a security to the property owner for caused damages in the accommodation property, and the property owner is entitled to cover the damage from the deposit. In case that the caused damage is higher than the deposited sum, the Renter is obliged to pay the total damage amount to the property owner. If no damage is caused to the accommodation property, the property owner is obliged to return the deposited sum to the Renter at the takeover of keys at the Renter`s departure. Please ensure you have this amount of money ready when you arrive otherwise entry into the accommodation property may be delayed until the deposit is produced.

Upon arrival, the Renter must hand in their travel and personal documents to the property owner, who will then register the Renter at the authorities and immediately return their personal documents if the paying is settled.
The time of arrival must be between 16:00h and 20:00h CET, while the time of departure is till 10:00h CET.
In the event of arrival not being possible before 20:00h, the Renter is obligated to notify the property owner, with whom they will arrange when to collect the keys. In the event of the Renter wanting to extend their stay, they are asked to promptly inform the owner who will, if the desired period is available, gladly book them an extension of their stay. In the case of an early departure, the Renter is required to pay the amount shown on the binding reservation.

Cleaning of the accommodation by Istra Vacation
Your accommodation will be clean at your arrival. The contract made between Istra Vacation and the property owner obliges the property owner to welcome the Renters in clean and well-prepared property. Any comments or remarks about cleaning or inventory need to be made on the arrival date (within 24 hours) to the representative. The Renters must leave the accommodation as found at his arrival.
The cleaning of the accommodation by the Renter
At leaving the accommodation the Renter has to take care of the following things: The (clean) dishes and cutlery have to be tidied and the remaining kitchenware has to be put in the provided closets. The dishwasher (if existing) has to be empty.
Leave the sheets on the bed. All rubbish must be removed from the accommodation and dumped in the therefore provided central containers (not inside the house!).
The fireplace and the barbecue have to be empty and cleaned.
You have to put the furniture in the right place on the terrace and you have to take care, that there is no rubbish lying in the garden or on the terrace.
You need to leave the accommodation clean.
If you don’t leave the accommodation as described as above, the property owner will charge your deposit for additional cleaning with a maximum of € 250,-. If hired bedlinen are torn, have stains (like henna tattoos, ink) or are otherwise damaged or rendered unusable, property owner will deduct the replacement cost from the deposit.

All personnel, employees or delegates of Istra Vacation or property owner have the right to enter the accommodation at all times. The property owner or Istra Vacation will try to inform the Renter about their visits.

It is possible that during your stay while using some utilities (eg water, electricity, gas) temporary disruptions in the supply occur. Istra Vacation has no influence here, and can not be held liable for such interruptions. If the accommodation has gas bottles, it could be possible that the gas is going to be empty after a while. If there are no gas bottles kept in reserve at the accommodation, the representative will replace the bottles within two working days after reporting this to the property owner.

Renters’ liability
During your stay in the accommodation property as a Renter, you are fully responsible for the rented accommodation, inventory and other items belonging to the accommodation. Damages caused by your fault and/or your travel companions should be reimbursed for replacement value and is due immediately to the representative. The property owner is entitled to use the deposit for this. In case of extreme damage to the property or serious nuisance to residents caused by the Renter, Istra Vacation or property owner has the right to cancel the contract immediately without any refund. The parking of caravans/pitching of tents is strictly forbidden.
If you are intending to organize private functions (e.g. party, wedding, cocktail party) at the property, you must seek prior permission from the Istra Vacation/property owner.
Additional charges and/or increased security deposit may be sought at the owner’s discretion.

Istra Vacation acts as a representative of the property owner and therefore Istra Vacation is not responsible for anything more than being the middleman between the Renter and the property owner/hirer. In any case, Istra Vacation can only be held liable for the paid rental fee by the Renter. Istra Vacation is not responsible for loss, theft, damage, breach or delay due to any cause beyond our reasonable control, caused to or by Renter and his/her companions of Istra Vacation mediated accommodations. Neither Istra Vacation nor the property owner shall be responsible for the death of, or personal injury of any member of a booking party, or of any other person at the property. Istra Vacation is not liable for any nuisance during the stay, the malfunction of technical equipment of the accommodation, temporary outages or disruptions of water and/or energy management, road and/or construction work in the surrounding area.
Neither Istra Vacation/property owner can be held responsible for noise or disturbance originating beyond the boundaries of the property or which is beyond our control. In the event that a source of noise has been in existence prior to your arrival and we are informed of this, we will contact you to inform you of the disturbance.
Properties which are located in a rural environment may encounter flora and fauna such as mosquitoes, wasps, ants, local dogs etc. as well as other environmental activities e.g. farming, drains etc
Istra Vacation will not be held responsible for any of the following externals: strike, war, monetary crisis, political or social unrest, disease, quarantine, acts of god or any events beyond our control or unexpected conditions
Istra Vacation is not responsible for damages caused by activities such as (but not limited to) cart-racing, jet-ski riding, horse riding, golfing, motorcycle, scooter, and other vehicle rentals, diving, pool swimming, falls from pool decks, wet tiles and or stairs along with any sliding glass door injuries. Therefore, each Renter and his companions agree that he/she/they is/are voluntary participating in any of these and similar activities, and by that he/she/they accepts/accept all risks of injury, illness, damage or loss of property that might be generated.
Istra Vacation is responsible for the accuracy of the description of the accommodation. However, the description and impressions of the accommodation and the immediate area, including facilities, equipment and so forth can due to their nature or due to interim changes or season influences differ from the description on the website of Istra Vacation.
Should you, despite all the care and effort of Istra Vacation consider that you have a legitimate complaint regarding your holiday home, you must immediately notify accommodation owner / Istra Vacation by phone: +385 (0)98 964 4690 or by email to info@istra-vacation.com. Failure to alert us of any problem whilst you are in the accommodation will lead to a rejection of your complaint.
Please write clearly your booking ID number and name of the accommodation property. The complaint will be handled with the greatest care. In case of any problems during your stay in our properties, we are available for trouble call 0 – 24 hours.

The parties commit to seeking to resolve any disputes by mutual agreement, and if this is not possible, in the event of a legal dispute the court in Pula has jurisdiction and the law of the Republic of Croatia is applied.

This Privacy Policy governs the manner in which Istra Vacation collects, uses, maintains and discloses information collected from users (each, a “User”) of the http://www.istra-vacation.com/ website (“Site”). This privacy policy applies to the Site and all products and services offered by Istra Vacation.

Personal identification information

We may collect personal identification information from Users in a variety of ways in connection with activities, services, features or resources we make available on our Site..
